(2) the scope of supply of energy generated
on the tendered area, as evidenced by
one or more bilaterally signed statements with another company to enter
into a supply contract in the future;
(3) the proportion of OWTGs in relation
to the total number of OWTGs that are
neither established by the use of impulse
pile driving nor established by gravity pile
driving;
(4) the ratio of trainees to employees subject to social security contributions at the
time of bid submission.
The tenders will be evaluated on criteria
corresponding to the above information
on a point-based system under which
the bidder with the best performance
receives the full number of points for the
respective evaluation criterion.
The bid value in Euro per MW which
reflects the payment to be made by the
bidder to the state is the most important criterion with a maximum score of
60 points while the other criteria have
maximum scores of ten points each.
The award will be given to the bidder
with the highest total number of points
received.

(f) Delays and effects of delays
Bidders are bound by certain project realisation milestones (see section 2.4 below).
In case of delays with the realisation of the
project against the mandatory realisation
timeline, the bidder is subject to penalties
payable to the competent TSO. Furthermore, in case of certain material delays, the
Federal Network Agency is obliged to revoke
the award of the bid.
(g) Security
Bidders are required to provide a security to
the Federal Network Agency which secures
potential claims of the TSO for penalties
(see above). A security for a partial amount
needs to be provided as a precondition for
the participation in the tender; the remaining amount needs to be provided in case of
a successful bid.
The required security amounts to EUR 100
per kilowatt of installed capacity in case of
non-pre-investigates sites and EUR 200 per
kilowatt of installed capacity in case of preinvestigates sites (cf. sec. 18 and 52 Offshore
Wind Energy Act).
(h) Bid volume
The bid volume (installed capacity) must
correspond to volume tendered for the
specific site.
