application (Art. 21(2) OWEA). If several
applications comply with Article 14 of the
Act, the Minister will issue the permit to the
party that is granted the subsidy (Art. 21(1)
OWEA).
In tenders with a comparative test, amongst
others things, the likelihood that the wind

farm will actually be realised and the
contribution of the wind farm to the energy
supply will be taken into account when
preparing the ranking (Art. 24 OWEA).
In principle, the Minister decides on the
applications within 13 weeks of the tender
period. This time limit can be extended once
with another 13 weeks (Art. 25 OWEA).
III. Public law and Regulatory Permits
A. Spatial planning at sea
The spatial planning of OWFs in the
Netherlands is mainly subject to the OWEA
and the Water Act (“Waterwet”).
In the National Water Program 2022-2027,
which is currently being finalized and which
finds its legal basis in the Water Act, the
Minister of Economic Affairs and Climate
Policy can appoint designated areas which
are deemed suitable for OWFs. A so-called
Wind Farm Site Decision (“kavelbesluit”)
can be adopted for the development of an
OWF in a designated area. So far, the Dutch
Minister has allocated several designated
areas for OWFs. These areas are indicated
below in red and orange.1 In the yellow areas,
the suitability for wind farms will be
examined.
