(b) The onshore grid connection
Key procedural requirements for onshore grid connection include the following
key authorisations (in chronological
order):
(i)
letter of synchronisation evaluation;
(i)
preliminary synchronisation negotiation;
(i)
detailed synchronisation negotiation; and
(i)
execution with Taiwan Power
Company ("Taipower", a state-owned company as elaborated below)
of the Power Purchase Agreement
("PPA"), or the corporate power
purchase agreement with private
end-users through the wheeling
services provided by Taipower
pursuant to the power wheeling
agreement (based on a template
prescribed by Taipower).
In addition, for the OWF project developers who were awarded the grid
capacity in Phase II of the Program, the
developers are required to enter into
administrative contracts (each an "AC")
with the MOEA. The steps above apply
to OWF project developers in Phase III of
the Program as well.

3.3 Permitting process
There are a number of key regulatory authorities governing renewable energy project
developments. The MOEA and the BOE
under the MOEA are the primary regulatory authorities in charge of the electricity
industry and the renewable energy generation industry. The BOE is responsible for
setting the policies for electricity businesses
and the power prices, enacting technical
regulations, and supervising the administration of electricity facilities. In addition
to the BOE, renewable power projects are
subject to regulation by certain central and/
or local authorities, such as the Environmental Protection Administration (EPA) and the
National Property Administration (NPA), in
relation to matters such as environmental
protection and use of state-owned land.
The major procedures for applying for the
key permits are summarised as follows:
(a) EIA Approval, the OWF developer should
submit a draft, full-scale EIA report
(including technical studies and consultations with key stakeholders) to the
review committee convened by the EPA
and the report has to pass several stages
of review meetings. With increasing
concerns about impacts on the marine
wildlife such as the Indo-Pacific Humpback Dolphin (also known as the Taiwanese White Dolphin), the Ocean Affairs
Council designated and announced the
