3) Application for the
Preliminary License:
After completing the steps outlined
above, IBAMA evaluates the environmental studies of the offshore wind
project to determine if it is environmentally feasible. If the project is
deemed viable, a Preliminary License
is issued with conditions that the developer must meet in the later stages
of the licensing process. It’s important
to note that presenting the environmental license is now a requirement
for businesses that wish to participate
in energy generation auctions, as
stated in Ministerial Order MME No.
102/2016.
(b) Installation License:
The Installation License (Licença de
Instalação, or LI) authorizes the installation of the wind turbines and related
infrastructure, in accordance with the
specifications contained in the plans,
programs and projects approved in the
previous phase.
(c) Operating License:
The Operating License (Licença de
Operação, or LO), in turn, authorizes
the operation of the power generation
assets, after verification of effective
compliance with what is stated in the LP
and LI, with the environmental control
measures and conditions determined for
the operation.
3.3 Licensing process of
onshore grid connections
Similarly, the construction and operation of
the onshore grid connection for electricity
generation projects requires certain public
or regulatory permits. These include environmental licenses to assess environmental
impact, grid connection authorization from
regulatory authorities such as ANEEL, land
use permits for access to property, and
construction and operation permits from
local authorities. Compliance with specific
requirements may vary depending on the
project’s location and scale.
24 Larger-scale projects with significant environmental impacts usually require an EIA, while the RIMA provides a summary of the EIA for the public. Smaller-scale projects with lower environmental impacts may only need a simplified report called a RAS. The specific requirements may vary, but the choice of
report depends on the project’s size and potential environmental effects.
