2.4 Timeframe for the realisation
of the project
As a principle, treatment of any delay to
commission the offshore wind installation
is generally set in the specifications of each
tender.19
Under the French OWFs first call for tenders’
specifications, the project holder has to
commission:
(a) at least 20% of total power of the installation at the latest six years after having
been chosen to implement the project;
(b) at least 50% at the latest seven years
after the same date; and
(c) the entire OWF installations at the latest
eight years after the same date.
Under the second call for tenders’ specifications, the project holder has to commission:
(a) at least 40% of total power of the installation at the latest 87 months after having
been chosen to implement the project;
(b) at least 90% at the latest 99 months after
the same date; and
(c) the entire OWF installations at the latest
111 months after the same date.

Under the third call for tenders’ specifications, the project holder has to commission
the entire OWF installation no later than at
the latest date between:
(a) 84 months after the Minister in charge of
energy has notified to the prospective
candidate its designation; and
(b) 12 months after the deadline for national
operator of the electricity transport
grid (in French: Reseau de transport
d’électricité – RTE) to make connection
facilities available – which is fixed at 42
months after the latest date between the
delivery of the authorisation to use the
public domain relating to undersea grid
connection facilities and the delivery of
the environmental authorisation needed
to implement undersea grid connection
facilities.
Under the fourth tender procedure’s specifications, the commissioning has to take place in little more tight deadlines. The project
holder has indeed to commission the entire
OWF before the latest date between:
(c) 72 months after the Minister in charge of
energy has notified to the prospective
candidate its designation;
(d) 9 months after the deadline for RTE to
make connection facilities available; and
(e) 9 months after the effective date at
which RTE has made available the connection facilities.
